1. Introduction & Acceptance of Terms

By downloading, installing, accessing, or using the Kartička mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

1.1 Definitions

• "Kartička," "we," "us," "our": Cask Coded s. r. o., the company that owns and operates the App.
• "User," "you," "your": The person using the App.
• "Services": The Kartička iOS mobile application and all related features and functionality.
• "Card Data": Loyalty card barcodes, names, images, and associated metadata stored in the App.
• "Free Tier": Basic app functionality available at no cost.
• "Kartička Premium": One-time upgrade providing unlimited card storage.

2. Service Description

2.1 Kartička App

Kartička is a loyalty card management application that allows you to:

• Store and organize loyalty and membership cards digitally
• Scan barcodes and QR codes using your device camera
• Display card barcodes at checkout for scanning
• Browse a catalog of 220+ popular brands
• Mark favorites and use smart sorting to find cards quickly
• Sync your cards across devices with iCloud
• Access your cards offline

Kartička Premium is an optional one-time purchase providing additional features:

3. Account & Authentication

Kartička does not require an account. The premium upgrade is handled entirely through Apple's StoreKit framework - no sign-in or registration is needed.

3.1 Data Removal

To remove your data, simply delete individual cards within the app. Uninstalling the app removes all locally stored data. If you enabled iCloud sync, you can manage or delete synced data through your Apple ID settings.

4. Purchase Terms (Kartička Premium)

4.1 One-Time Purchase

Kartička Premium is available as a one-time purchase for $1.99. This is a non-consumable in-app purchase - it is not a subscription and does not renew or expire.

4.2 Family Sharing

Kartička Premium supports Apple's Family Sharing. Once purchased, family members in your Family Sharing group can access the premium upgrade at no extra cost.

4.3 Refunds

All purchases are processed by Apple. If you would like to request a refund, please contact Apple Support directly through the App Store or at reportaproblem.apple.com.

4.4 Purchase Restoration

If you reinstall Kartička or switch to a new device, you can restore your purchase at no additional cost. Use the "Restore Purchase" option in the app to re-activate your premium access.

5. Acceptable Use

5.1 Permitted Use

You may use Kartička for:

• Storing your own loyalty and membership cards
• Scanning barcodes of cards you own
• Personal, non-commercial card management
• Using the App in compliance with all applicable laws

5.2 Prohibited Use

You may NOT use Kartička for:

• Storing cards that do not belong to you
• Fraudulent activities or misuse of loyalty programs
• Reverse engineering or attempting to extract source code
• Commercial purposes without prior written permission
• Using automated tools (bots, scripts) to manipulate the App

6. Intellectual Property

6.1 Your Data

You retain all ownership rights to the card data you store in Kartička. We do not claim any ownership of your data. We do not access, use, or share your card data for any purpose.

6.2 Kartička Intellectual Property

All rights, title, and interest in the App, including software code, design, branding (name, logo, trademarks), and features are owned exclusively by Cask Coded s. r. o.

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal use in accordance with these Terms.

7. Disclaimers & Limitations of Liability

Barcode Accuracy: While we strive for accurate barcode scanning, we cannot guarantee that every barcode will scan correctly at every retailer. Always keep your physical cards as backup.

Maximum Liability: Our total liability to you is limited to the amount you paid for Kartička Premium.

8. Privacy & Data Protection

Your use of Kartička is also governed by our Privacy Policy. By using the App, you consent to the data practices described in the Privacy Policy.

9. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you via in-app notification or updated "Last Updated" date. We will provide at least 30 days' notice before material changes take effect.

Continued Use = Acceptance: Continued use of Kartička after the updated Terms take effect constitutes your acceptance of the changes.

10. Governing Law

These Terms are governed by the laws of the Slovak Republic, without regard to conflicts of law principles.

Informal Resolution: Before filing any legal claim, you agree to contact us at studio@caskcoded.com to attempt informal resolution. We will respond within 30 days and work with you in good faith to resolve the issue.
